Visa Appeals and the AAT

In my capacity as a senior migration agent at YUN Migration & Education, I offer expert representation for clients at the AAT. The Tribunal's purview includes reviewing decisions related to visa and migration matters, along with citizenship issues. Our track record boasts a remarkable 98% success rate in cases where we've represented client interests.

Overview of the AAT

The Administrative Appeals Tribunal (AAT) plays a crucial role in providing an independent review of administrative decisions under Commonwealth law. This includes scrutinizingdecisions made by Australian Government ministers, departments, and agencies. Additionally, it reviews certain decisions from state, non-state entities, and those aligned with Norfolk Island laws.

AAT's History and Composition

Established by the Administrative Courts of Appeal Act, the AAT commenced operations on July 1, 1976. Notably, as of July 1, 2015, it integrated the Migration Tribunal, Refugee Tribunal, and Social Security Appeals Tribunal into its structure.

Comprising the President, Deputy Presidents, Senior Members, and Members, the AAT's panel is enriched with expertise in diverse fields including law, medicine, migration, and more. This multidisciplinary team considers new information and conducts hearings to assess evidence rigorously.

Tribunal's Decision-Making Process

The AAT meticulously reviews cases, especially those concerning migration, refugee visas, visa decisions, and Australian citizenship. Each decision is re-evaluated 'on the merits', within the confines of relevant legislation. This process involves a comprehensive re-examination of all facts, arguments, and evidence, culminating in a fresh decision.
